Restructure your debt with bankruptcy

Recently, you may have been considering filing for bankruptcy. You may have been reading up on bankruptcy topics to help you in making the choice of whether or not to file. One of the topics you may be most interested in is what the exact benefits of bankruptcy are. Bankruptcy can have many benefits for individuals who file. Here is an overview of just some of these benefits.

The first and most obvious benefit of filing for bankruptcy is that it may help solve your debt issues. Obviously, individuals who are considering filing for bankruptcy are doing so because they have been put in a position where it is pretty much not possible for them to pay off all the debts they owe.

This may have occurred for a number of purposes. Perhaps, an individual lost his or her job or accumulated medical bills that weren't covered by his or her health insurance. Whatever the reasons may be, people file for bankruptcy to find a path to a new start free of their debt issues.

In a Chapter 7 bankruptcy, this freedom is normally obtained after a six month procedure. After these six months, a debtor is likely to see his or her debts completely discharged. After the remove, they no longer have to be paid. Under a Chapter 13 bankruptcy, the debts will be restructured into a new payment plan the debtor will be able to much more easily pay off in a period of two to five years.

Another strong benefit of filing for bankruptcy is something called an "automatic stay." A bankruptcy filing will act as an automatic stay as soon as it has filed. The automatic stay is what legally prevents creditors from harassing the debtor during bankruptcy proceedings. If you are continually getting harassed by lenders over the phone or through the mail, this will end as soon as you file for bankruptcy and get an automatic stay. The lenders will no longer legally be able to attempt to collect payment from you in any way. Instead, the creditors must deal with a court appointed trustee. If the creditors break this stay, they might be seriously penalized.

Lastly, a bankruptcy can secure your property. For one, a bankruptcy will stop a foreclosure from taking place. If a person's house is in danger of falling into foreclosure, bankruptcy is one sure fire way to save the home. If an individual has problems keeping up with his or her payments on the mortgage, these mortgage payments can be restructured during a section 13 bankruptcy in a way that person will be able to pay. If an individual's assets is in danger of being repossessed, a bankruptcy filing will also stop this repossession from taking place. Repossessed assets may even be returned to the debtor if the debtor acts quickly enough to file for bankruptcy.

These are only some of the benefits that filing for bankruptcy may entail. There are also serious negative impacts that can result from filing for bankruptcy as well. This is why you should make sure you have used all other choices for managing your debt before you make the decision to file for bankruptcy.
